Agreement

These Terms of Service are a legal agreement between you and Nooksite for the use of our website design and ongoing care-plan services. By using our site, submitting an inquiry, or purchasing services, you agree to these terms.

Our services

Nooksite designs and builds custom websites for takeout restaurants and provides an optional monthly care plan that includes hosting, maintenance, updates, and support. Specific deliverables and timelines are agreed upon after you complete our intake questionnaire and approve the proposed design.

Acceptance

By continuing to use our website or services, you confirm that you have the authority to enter into this agreement and that all information you provide is accurate and complete.

Acceptable use

You may not use our services for unlawful purposes, fraud, spam, intellectual-property infringement, security interference, malware distribution, unauthorized scraping, or any activity that harms our systems or other users.

Intellectual property

Nooksite retains ownership of our software, templates, designs, documentation, and branding. Upon full payment, we grant you a limited, non-exclusive, non-transferable right to use the website we build for your restaurant. You retain ownership of your content, logos, and menu materials.

Service level

We aim to deliver high-quality work on agreed timelines, but we do not guarantee uninterrupted or error-free service. Hosting and third-party integrations may experience downtime beyond our control.

Payments, billing, and subscriptions

Payments for our services are processed securely by Stripe on our behalf. Nooksite is the seller and merchant of record for all orders. The $799 website build fee and the first month of the $50 care plan are charged together at checkout after you approve the design. The care plan then renews monthly unless canceled.

Card details are collected and stored by Stripe; Nooksite never stores your full card number. Applicable sales tax may be added at checkout. You can update your card, view invoices, or cancel your care plan at any time from your account page. Cancellation takes effect at the end of the billing period you have already paid for — access is never cut off mid-period, and partial months are not prorated.

Account credentials

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.

Warranties and disclaimers

Our services are provided “as is” and we disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

Limitation of liability

To the extent permitted by law, Nooksite's aggregate liability is limited to the fees you paid to us in the six months preceding the claim. We are not liable for indirect, consequential, or special damages such as lost profits, data loss, or goodwill, except where liability cannot be excluded by law.

Suspension and termination

We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious violations of these terms. Upon termination, your care plan access continues until the end of the current paid billing period.

Governing law

These terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles.

Changes to terms

We may update these terms from time to time. Continued use of our services after changes means you accept the updated terms.
